Welcome to HavaScoopers LLC ("Service Provider"). These Terms of Service ("Terms") govern your use of our pet waste removal services ("Services"). By signing up for our Services, you ("Client") agree to be bound by these Terms. Please read them carefully.

Services Provided

HavaScoopers LLC agrees to provide the following pet waste removal services:

Routine Removal: Regular removal of pet waste from designated areas on a scheduled basis (e.g., weekly, bi-weekly), including responsible disposal in the Client’s designated trash area unless otherwise directed.

Initial Cleanups: Cleanup of properties with excessive waste accumulation may incur additional charges, which will be communicated and agreed upon prior to service.

Service Adjustments: Services may be adjusted, paused, or terminated due to aggressive pets, unsafe yard conditions, or denied access.

Optional Services: Additional services such as deodorizing or yard treatments are available upon request and will be billed separately.

Scope of Services: Services are strictly limited to the items listed above. Any modifications or additional services must be agreed upon in writing by both Parties. HavaScoopers LLC does not perform lawn care, landscaping, or maintenance beyond pet waste removal.

Pricing Structure

Monthly Pricing: All pricing is established on a monthly equivalent basis as detailed on our Pricing Page. The per-scoop rate (e.g., $19 per scoop) is converted into a monthly equivalent to streamline billing. For example, a weekly service for 1 dog priced at $19 per scoop results in a monthly rate of approximately $82.33 (based on an average of 4.33 weeks per month). This ensures consistent and straightforward billing for customers who prefer a simple monthly invoice, rather than multiple smaller charges for each individual service.

Prorated Billing: Payments are prorated based on the service start date within the month. The first invoice will reflect the exact number of services provided, ensuring that you are billed fairly for the actual services you receive in the first month. However, the first invoice amount will not exceed the agreed-upon regular monthly price.

Customized Pricing: Pricing is determined based on the frequency of service visits and the number of dogs per household, as discussed verbally during the initial consultation. By agreeing to these Terms, you acknowledge and accept the pricing agreed upon verbally.

First Invoice: The first invoice will include the price for all services provided before the start of the regular monthly billing cycle, with the total not exceeding the regular monthly price. This ensures fair billing for the initial period of service.

Rate Adjustments: HavaScoopers LLC reserves the right to adjust service rates with a minimum of 30 days’ written notice to the Client. Rate adjustments will be based on operational costs, inflation, or changes in service scope.

Client Responsibilities

The Client agrees to the following responsibilities:

Property Access: Ensure that gates are unlocked, pets are restrained, and the property is accessible during scheduled service times. If access is denied, the service will be rescheduled, and the Client may be charged for the missed visit.

Safe Property Conditions: Maintain the property in a condition that is safe for HavaScoopers LLC personnel, free of hazards such as debris, sharp objects, or aggressive pets. Hazardous conditions may result in service delays, cancellations, or additional charges.

Notification of Changes: Promptly notify HavaScoopers LLC of any changes in contact information, access codes, or property conditions that may impact service delivery.

Invoice Review: Review all invoices and service reports promptly and address any concerns within 10 days of receipt to ensure timely resolution. Failure to communicate issues within this timeframe will be deemed acceptance of the services rendered.

Compliance with Laws: Comply with all applicable local laws and regulations related to pet waste management, property maintenance, and access to utilities needed for service completion.

Payment Terms

The Client agrees to pay HavaScoopers LLC according to the following terms:

Pricing: As outlined in the Pricing Structure, based on service frequency and number of dogs.

Invoicing Frequency: Invoices are issued in advance on the first of each month, covering services to be rendered in that month.

Payment Method: HavaScoopers LLC collects a valid method of payment, which must be guaranteed by the Client. This payment method will be used for automatic recurring payments of the monthly service fee. By agreeing to these Terms, the Client authorizes HavaScoopers LLC to automatically charge the specified payment method on a monthly basis. Accepted payment methods include electronic funds transfer (EFT), credit card, or other agreed-upon methods. Payments are due upon receipt of the invoice.

Failure to Pay: If payment is not received by the due date, services will be suspended until payment is made. Repeated payment failures may result in termination of this Agreement.

Rate Adjustments: Refer to the Pricing Structure for details on rate adjustments.

Access and Service Interruptions

Unrestricted Access: The Client must ensure unrestricted access to the property. HavaScoopers LLC is not responsible for missed services due to locked gates, unrestrained pets, or hazardous yard conditions. In such cases, services will be rescheduled, and the Client will be contacted.

Unforeseen Circumstances: Service interruptions caused by unforeseen circumstances, such as severe weather, equipment failure, or staffing shortages, will be addressed promptly. HavaScoopers LLC will make reasonable efforts to reschedule affected services at the earliest availability.

Cancellation, Rescheduling, and Termination

Service Provider Rights: HavaScoopers LLC reserves the right to refuse or terminate services immediately if conditions are deemed unsafe, access is repeatedly denied, or if there is a failure to comply with this Agreement.

Client Cancellation: The Client may cancel or reschedule services by providing written notice at least 24 hours in advance. Cancellations made without adequate notice may result in a charge equivalent to the missed service fee.

Termination by Either Party: Either Party may terminate this Agreement at any time with or without cause by providing written notice to the other Party. The final invoice will be prorated based on services rendered up to the termination date.

Liability and Indemnification

Limitation of Liability: HavaScoopers LLC shall not be liable for any damage, injury, or loss arising from pre-existing conditions on the Client’s property, including but not limited to aggressive pets, hazardous yard conditions, or denied access. The total liability under this Agreement shall not exceed the total amount paid by the Client for services rendered in the preceding 12 months.

Indemnification: The Client agrees to indemnify, defend, and hold harmless HavaScoopers LLC, its employees, and subcontractors from any claims, damages, or liabilities arising from the Client’s negligence, failure to provide safe access, or failure to comply with local laws and regulations.

Environmental and Health Considerations

Waste Disposal: Pet waste will be removed and disposed of according to local regulations, with all waste placed in the Client’s designated trash area unless otherwise specified.

Health Disclaimer: HavaScoopers LLC assumes no responsibility for health issues, environmental damage, or pest infestations resulting from waste accumulation or improper disposal beyond the standard service scope. The Client acknowledges that pet waste can contain harmful bacteria and parasites, and it is their responsibility to maintain a safe and clean environment between service visits.

Right to Refuse Service

HavaScoopers LLC reserves the right to refuse or reschedule services if pets are unrestrained, the yard is deemed unsafe, or access is denied. Repeated refusal or access issues will result in additional charges or termination of services. HavaScoopers LLC’s personnel are instructed not to enter any area where their safety is compromised, and HavaScoopers LLC will not be held liable for service failures under such conditions.

Non-Solicitation of Employees

The Client agrees not to directly solicit, hire, or engage any of HavaScoopers LLC’s employees or subcontractors during the term of this Agreement and for a period of 12 months following its termination. Violation of this provision will result in a penalty fee equivalent to one year of the employee’s salary or compensation.

Dispute Resolution

Any disputes arising under this Agreement shall first be resolved through good-faith negotiations between the Parties. If a resolution cannot be reached, the dispute shall be submitted to binding arbitration under the rules of the American Arbitration Association. The prevailing Party shall be entitled to recover reasonable attorney’s fees and costs incurred in resolving the dispute.

Amendments and Entire Agreement

This Agreement constitutes the entire understanding between the Parties regarding the Services provided and supersedes all prior agreements, discussions, or representations. Any amendments to this Agreement must be made in writing and signed by both Parties. The terms herein are binding and enforceable upon execution.

Client Acknowledgment

By signing up for HavaScoopers LLC’s Services, the Client acknowledges that they have read, understood, and agree to all terms and conditions outlined in these Terms of Service. HavaScoopers LLC looks forward to maintaining the Client’s property in a clean, safe, and waste-free condition.
